An Abuja High Court sitting at Jabi has ordered the Abuja Municipal Area Council (AMAC), Pedogs Investment Ltd and Zenith Bank plc to appear before it tomorrow to show cause why an order absolute should not be made against them in respect of judgment sum to the tune of N170million which they have failed to offset.
In the suit, Maxrings Nig Ltd is the judgement creditor/applicant, Abuja Municipal Area Council is the 1st judgement debtor, Pedogs Investment Ltd is the 2nd judgement debtor, while Zenith Bank is the garnishee.
The order was made as a result of an urgent request brought before the court by Wilson Ivara, counsel representing the judgment creditor/applicant, Maxrings Nig Ltd, which the court granted.
In granting the urgent application, the trial judge, Justice O.A Musa said: "You are hereby ordered to appear at the FCT High Court sitting in Jabi, on December 8, 2016 to show cause why an order absolute should not be made upon you for the payments to the judgement creditor of the amount of the debt due and owing or accruing from you to the said judgment creditor much thereof as will satisfy the judgment sum" the ex-parte order added.
In a 13-paragraph affidavit deposed to by one Michael Odewale, disclosed that the FCT High Court delivered consent judgment in the substantive suit no. FCT/HC/CV/1468/2016 on 19 May 2016, and ordered the 1st and 2nd judgment debtors to pay the judgment creditor the judgment sum of N170million as compensation.
It was stated that the 1st and 2nd judgment debtors were duly represented by their counsel on the day of consent judgment was entered as final judgment of the court.
More so, the deponent averred that "the judgment debtors were served copy of the judgment certificate, hence they are fully aware of the court's judgment but have failed, refused and neglected to liquidate the judgment debt due and payable to the judgement creditor till date.
